The phone can be blacklisted if it is simply lost as well. While trying to find out what to do in this case of a blacklisted phone one forum topic was a a guy that lost his phone, reported it lost, the lost phone was blacklisted then some time later his gf/wife found it some where hidden in the house and was asking what he could to to get it blacklist removed. My point is that we don't know how or why it was blacklisted. So don't assume it's stolen. As for the jailbreak, there is nothing illegal about it. It is perfectly 100% legal to do. The catch is that Apple does not support it, and that is a completely different issue.
