| QUOTE (chris @ Wednesday, Feb 29 2012, 17:53) | [QUOTE=MikeWh,Wednesday, Feb 29 2012, 13:52] Last year i got pulled 42 times for random vehicle stops, on 5 occasions i was breathalized despite being a non drinker. I got a new car last week, and it took a total of 4 days to be pulled over. I asked why i was pulled over and the officer told me my brake lights didn't work around a corner, i told him that was probably because i didn't brake and as far as i'm concerned isn't illegal. He then made me and my friends stand outside in the pissing down rain to be searched and then began searching my car whilst his partner did identity checks or whatever.
I'm sick of getting pulled over for no f*cking reason, Merseyside police is full of jobsworth bellends, i'm as polite as i can bare to be with them when they're wasting my time and yet i still get pulled over every other day so i have a few questions for you.
1. Can police pull you over for no reason? 2. What rights do i have to not be searched in full public view for no reason? 3. Should i seek legal advice for harrassment as i believe i'm being targeted? 4. On what grounds can a police officer search my vehicle? | 1. Can police pull you over for no reason? Yes, they have the powers to do that under the Road Traffic Act - the 'without reason' is actually without warrant, they're able to stop you to find a problem - I've used this power before when my coppers' nose tells me something's not right and I've found some good arrests doing it! Without wishing to offend or generalise it's most likely that you 'look' suspicious and if you've got mates in the car it's even more so, I'd take it with a pinch of salt - I've heard bad things about Merseyside but they're not all bad! I'd suggest being as nice as possible to the officers and asking for a sit in their car if you all fit - I certainly would never let you get wet on a stop. 2. What rights do i have to not be searched in full public view for no reason? No rights, Section 17 of Police and Criminal Evidence Act and 23 of Misuse of Drugs Act allow public searches, intimate searches have to take place in a custody suite, authorised by an inspector and conducted by a doctor who have a 'no touch' policy. 3. Should i seek legal advice for harassment as i believe i'm being targeted? Not really, perhaps if you feel it's harassment (same coppers and such) take their collar numbers down, don't tell them you're doing it and make a complaint to Professional Standards, if it's not the same officers just ride it - it's not harassment and it won't be deliberate, you'll either look like a nominal or just look a tad suspicious. If you do get stopped say "You've been stopping me a lot lately", act friendly and try and slip it there that you're sick of it. You can do a subject access for about £20 and see what they store about you - might be something there causing them to stop you. 4. On what grounds can a police officer search my vehicle? Our powers to search come from section 17 of the Police and Criminal Evidence Act (1984) and the Misuse of Drugs Act (1971). For both of these all we need is 'reasonable suspicion' - I don't know what you look like so can't comment on that, but this can be appearance - yes, we do prejudice - normally that's right, sometimes we get it wrong. Though there are guidelines we must follow under both of those. GOWISELY. Grounds, Objective, Warrant Card, Identification, Station, Entitlement (to a copy of search record), Legal Power of search and 'You are detained for the purposes of a search. If they don't do that, collar numbers, and complain because that is UNLAWFUL. I do my best to be polite with those I stop and search; I shout up first (fake call signs) "YM YM, PX21 - Stop search on X street, open mic please" they then open my mic on my airwave, meaning EVERYTHING is recorded, no complaints then "Sorry to bother you lads [mate/miss/madam/sir] - I've been told by such and such/you look like somebody who was seen to be doing X, I'm sure you're not but I've got to check *shows warrant card - if in uniform, collar number* - I'm PC Bloggs from Sandford Police Station and I'm detaining you for the purposes of searching you for Offensive Weapons/Drugs/Items linked to crime/Stolen property under the Misuse of Drugs Act/Police and Criminal Evidence Act - You're entitled to a copy of the search record from Sandford Police Station in the next 6 months or me now if you wish - very sorry to ask but have you got anything on you that you shouldn't have mate?" Then it's all recorded and I'd like to think I change people's attitudes towards us if I'm friendly and nice about it - so many officers are such morons these days! RE: 'Identity checks" (Hash name checks on PNC no doubt) each time you're checked on PNC it's logged and audited, location, time and officer - so you'll come back as 'BLOGGS/JOSEPH/01011971/SCOTLAND -- CHECK LAST ***** (collar) SOME STREET - DRUGS 01022012 1941' - if you do a subject access you can see who's done it and take it from there if it's truly harassment.

| QUOTE (jaysteels @ Thursday, Mar 1 2012, 22:35) | | QUOTE (Outcast @ Thursday, Mar 1 2012, 12:19) | i've been given the choice to get a new car to replace my ageing Infiniti in China. who else would i ask but you guys for suggestions?
but seriously, im not going to go out and get a lambo or anything. just a good car for daily driving but the back has to be roomy enough for when im being driven
i quite fancy the new Saab 9-5 and but i dont think they sell Saabs in China which is a shame |
can't ship? Saabs make for amazing daily drivers |
I could ship but its just a lengthy and expensive process to clear china customs, if i were to go through the time and trouble of bringing a car in i'd rather make it count and import some pristine american classic. I would love to get a DTS but they dont have it in China, the closest we have is something called the SLS (STS in the rest of the world). I'd also really like to avoid BMWs or Mercs. What do you guys think of an '08/'09 Jaguar XJ? I like the old XJ much more than the new one which looks somewhat like a mondeo from the front.
